Terms of Service

Waggr — The Daily Dog

Effective Date: June 2026

Acceptance of Terms

By downloading, installing, or using the Waggr mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you are at least 13 and have the legal capacity to enter into these Terms. Certain features (such as household subscriptions) may require you to be 18 or older.

Accounts

You create an account using Sign in with Apple. You are responsible for maintaining the confidentiality of your device and for all activity that occurs under your account. You agree to provide accurate information and to update it promptly if it changes.

User Content and License

You retain ownership of the content you create and upload (dog photos, diary entries, Feed posts, Lost Dog Alerts, memes, etc.). By posting or sharing content through the App, you grant us a worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display that content solely as necessary to operate, improve, and promote the App and its features (including making Lost Dog Alerts visible to the community and enabling sharing of memes).

You represent that you have all rights necessary to grant this license and that your content does not violate any law or the rights of any third party.

Prohibited Conduct

You agree not to:

  • Post false, misleading, or harassing content, including false Lost Dog Alerts.
  • Use the App for any illegal purpose or in violation of any law.
  • Impersonate any person or entity.
  • Interfere with the App's security or operation.
  • Attempt to reverse-engineer or copy the App.
  • Upload content that is obscene, defamatory, or infringes intellectual property rights.
  • We reserve the right to remove any content and suspend or terminate accounts that violate these Terms.

Disclaimers and No Warranties

THE APP AND ALL CONTENT, FEATURES, AND SERVICES (INCLUDING AI-GENERATED MEMES AND LOST DOG ALERTS) ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We make no warranty that:

  • The App will be uninterrupted, secure, or error-free.
  • AI-generated memes will be accurate, appropriate, or meet your expectations.
  • Lost Dog Alerts will result in the recovery of any pet or that location information will be accurate or acted upon by others.
  • Information in the Diary (including medication logs) constitutes veterinary or medical advice.
  • You are solely responsible for the care of your dog(s) and for verifying any information before acting on it. The App is a tool to assist responsible ownership, not a substitute for professional veterinary care.

Limitation of Liability and Hold Harmless

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR PETS) ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to hold harmless, defend, and indemnify us and our officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your content or conduct; (c) your violation of these Terms; or (d) your infringement of any third-party right.

Termination

We may terminate or suspend your access to the App at any time, with or without notice, for any reason, including violation of these Terms. You may delete your account at any time through the App (data removal per our Privacy Policy). Upon termination, your right to use the App ceases immediately.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved informally by contacting support@waggr.app. If informal resolution fails, the dispute shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association before a single arbitrator in the Commonwealth of Virginia. The arbitration shall be conducted on an individual basis; class actions are not permitted. Judgment on the award may be entered in any court of competent jurisdiction.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles.

Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App. Your continued use after such changes constitutes acceptance.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements.
